RULEBOOK ON THE UNIFIED REQUEST FOR APPROVAL, I.E. EXTENSION OF TEMPORARY RESIDENCE AND ISSUANCE OF A WORK PERMIT TO A FOREIGNER

On November 26, 2020, the Minister of the Interior and the Minister of Labor, Employment, Veterans and Social Affairs adopted Rulebook on the unified request for approval, i.e. extension of temporary residence and issuance of a work permit to a foreigner (hereinafter: ,,Rulebook”). The Rulebook was published in the Official Gazette of RS no. 144/20 from November 27, 2020 and entered into force on November 28, 2020.

The Rulebook refers to Article 41a Paragraph 3 of the Law on Foreigners, which was added during the adoption of the Law on Amendments to the Law on Foreigners from 2019, when the final provisions of the Law on Amendments to the Law on Foreigners stipulate that the provision relating to new Article 41a apply from December 1, 2020. Accordingly, this Rulebook represents the fulfilment of the obligation prescribed by the Law on Amendments to the Law on Foreigners from 2019.

Rulebook on the unified request for approval, i.e. extension of temporary residence and issuance of a work permit to a foreigner prescribes a new form of the consolidated request and exhaustively stated evidence required with the residence permit and the issuance of a work permit to a foreigner. As before, in addition to the grounds for residence and the type of work permit, the documentation submitted for a certain type of work permit is also listed.

Certainly, it remains that the procedures for obtaining a temporary residence permit and work permit are two formally separate procedures and that each body resolves requests within its competence, but with this Rulebook when the National Employment Service receives a unified request from the Ministry of Interior, the employer / foreigner should forward the necessary documentation for issuing a work permit by e-mail to the address of the competent branch of the National Employment Service. Therefore, even after submitting the unified request, the foreigner will receive two different permits, one for temporary residence and the other for work, as has been the practice so far.

PRAVILNIK O OBJEDINJENOM ZAHTEVU ZA ODOBRENJE, ODNOSNO PRODUŽENJE PRIVREMENOG BORAVKA I IZDAVANJE DOZVOLE ZA RAD STRANCU

Dana 26.11.2020. godine, ministar unutrašnjih poslova i ministar za rad, zapošljavanje, boračka i socijalna pitanja su sporazumno doneli Pravilnik o objedinjenom zahtevu za odobrenje, odnosno produženje privremenog boravka i izdavanje dozvole za rad strancu (u daljem tekstu: ,,Pravilnik“). Pravilnik je objavljen u Službenom glasniku RS br. 144/20 od 27.11.2020. godine, a stupio je na snagu 28.11.2020. godine.

Pravilnik se poziva na član 41a stav 3 Zakona o strancima koji je dodat prilikom usvanjanja Zakona o izmenama i dopunama Zakona o strancima iz 2019. godine kada je u završnim odredbama Zakona o izmenama i dopunama Zakona o strancima propisano da se odredba koja se odnosi na novi član 41a primenjuje od 01.12.2020. godine. U skladu tim, ovaj Pravilnik predstavlja ispunjavanje obaveze koja je propisana Zakonom o izmenama i dopunama Zakona o strancima iz 2019. godine.

Pravilnik propisuje novi obrazac objedinjenog zahteva i taksativno navedenih dokaza koji su potrebni sa odobrenje boravka i izdavanja radne dozvole strancu. Kao i do sada, pored osnova za boravak i vrstu radne dozvole, navedena je i dokumentacija koja se podnosi za određenu vrstu radne dozvole.

Svakako, ostaje da su postupci pribavljanja privremenog boravka i radne dozvole dva formalno razdvojena postupka i da svaki organ rešava zahteve u okviru svoje nadležnosti, ali sa ovim Pravilnikom kada Nacionalna služba za zapošlavanje primi objedinjeni zahtev od Ministarstva unutrašnjih poslova, poslodavac/stranac bi trebalo da prosledi potrebnu dokumentaciju za izdavanje radne dozvole putem mejla na adresu nadležne filijale Nacionalne služba za zapošljavanje. Samim tim, i nakon podnošenja objedninjenog zahteva, stranac će dobiti dve različite dozvole, jednu za privremeni boravak i drugu za rad, kao što je praksa bila i do sada.
