National Day of Giving: Companies, CSOs, Media and Citizens United to “Save Food, Save Humanity”
BELGRADE – On October 9, 2021, the Coalition for Giving and the Serbian Philanthropy Forum marked the fourth National Day of Giving, with support from the United States Agency of International Development (USAID), by recognizing 34 companies, 12 civil society organizations and 12 media outlets that have contributed the most to the “Save Food, Save Humanity” campaign, or supported initiatives within the campaign.
“This year’s theme of advancing food donations and reducing food waste strongly aligns with core American values and traditions that we cherish deeply and put into practice every day,” said Anthony F. Godfrey, U.S. Ambassador to Serbia.
The recognized companies have supported the National Day of Giving and the campaign through generous monetary and/or food donations which will be directed at providing packages of essential food items to Serbia’s most vulnerable citizens. Many of the organizations and companies also supported the campaign by providing media space to promote the messages and help increase public awareness of the ongoing problem of food waste. As part of the awareness raising campaign, members of the media worked with famous chefs and restaurants to prepare lunch packs for the vulnerable, while several companies invited their staff to collect food items to contribute to the initiative. While it is expected within this campaign to collect enough food to satisfy basic needs of thousands of people in the next few months, the ultimate goal is to ensure that, in the future, food donations can become a reliable source of food for those who need it.
“Wise people say that life gives us as much as we are ready to give to others, and that a wealthy person is the one who is ready and willing to help others. These are the principles on which we are building a better, humane and solidary society,” said Darija Kisić Tepavčević, Minister of Labor, Employment, Veteran and Social Policy of the Republic of Serbia.
The campaign will run until mid-November in case other interested companies or organizations wish to join and contribute.
Also, during the event organized in Ilija M. Kolarac Endowment today, five paintings created by students of the Faculty of Applied Arts have been presented. The art pieces will be gifted to the selected companies which gave the exceptional support to the campaign.
While 480,000 people in Serbia live on the edge of absolute poverty, an estimated two million kilograms of food are being wasted daily. Despite the fact that food donations are increasing, and food producers and merchants want to donate surplus food to soup kitchens, food banks and charities, the amount of food donated still makes up only a small portion of the total surplus edible food available in Serbia. An analysis conducted by the Responsible Business Forum and the Coalition for Giving shows that food donations in Serbia could increase annually by a value of nearly 160 million dinars (to a total of 700 million dinars), if the VAT on food donations were to be abolished.
“We are especially proud that so many organizations from different sectors joined the campaign and supported National Day of Giving, we are truly stronger together. However, the real difference would be made once the problem with VAT on food donations is resolved,” said Veran Matić, Executive Director, Serbian Philanthropy Forum.

Nacionalni dan davanja: kompanije, NVO, mediji i građani ujedinjeni „Spašavaju hranu, spašavaju humanost“
Beograd – 9. oktobra 2021. godine Koalicija za dobročinstvo i Srpski filantropski forum obeležili su četvrti po redu Nacionalni dan davanja, uz podršku Američke agencije za međunarodni razvoj (USAID), odajući priznanja kompanijama (34), organizacijama civilnog društva (12) i medijskim kućama (12) koje su dale najznačajniji doprinos kampanji „Spasimo hranu, spasimo humanost“, ili su podržale pojedinačne inicijative u okviru kampanje.
“Ovogodišnja tema povećanja donacija hrane i smanjenja bacanja hrane potpuno je u skladu sa američkim vrednostima i običajima koje svakodnevno praktikujemo i negujemo”, rekao je Entoni Godfri, ambasador SAD u Srbiji
Kompanije koje su danas dobile priznanja su podržale Nacionalni dan davanja i kampanju velikodušnim novčanim donacijama i/ili donacijama u hrani koje će biti podeljene u vidu paketa osnovnih namirnica najugroženijim građanima u Srbiji. Mnoge od ovih organizacija i kompanija su takođe podržale kampanju ustupajući svoj medijski prostor kako bi podpomogle širenje poruka i podizanje svesti građana o problemu bacanja hrane. Kao deo kampanje zagovaranja, predstavnici medija su pripremali hranu sa poznatim kuvarima i restoranima koja je bila podeljena ugroženima, dok su neke kompanije pozvale svoje zaposlene da prikupe donacije u hrani kako bi dali doprinos ovoj inicijativi. I dok se očekuje da će u okviru ove kampanje biti sakupljeno dovoljno hrane da zadovolji osnovne potrebe hiljada građana u narednih nekoliko meseci, glavni cilj je osigurati da u budućnosti donacije hrane postanu pouzdan izvor osnovnih namirnica onima kojima su neophodne.
„Mudri ljudi su rekli da nam život pruža onoliko koliko smo spremni da pružimo drugima i da je bogat samo onaj čovek koji može i želi da pomogne drugima. Upravo na tim principima zajedno stvaramo bolje, humano i solidarno društvo”, rekla je Darija Kisić Tepavčević, ministarka za rad, zapošljavanje, boračka i socijalna pitanja.
Kampanja će trajati do sredine novembra za slučaj da ostale zainteresovane kompanije i organizacije žele da se uključe i doprinesu.
Danas su tokom događaja u Zadužbini Ilije M. Kolarca takođe bile predstavljene slike koje je uslikalo pet studenata Fakulteta primenjenih umetnosti. Ova dela mladih umetnika će biti poklonjena odabranim kompanijama koje su pružile izuzetnu podršku kampanji.

„Nama je posebno drago što se ove godine priključio i podržao Nacionalni dan davanja ovako veliki broj organizacija iz različitih sektora poslovanja, to pokazuje da smo zajedno jači. Ipak, najznačajniji pomak u rešavanju ovog problema bi bio napravljen ako bismo uspeli da najzad rešimo pitanje ukidanja PDV-a na donacije hrane“, rekao je Veran Matić, izvršni direktor Srpskog filantropskog foruma.

Pokrenuta kampanja „Spasimo hranu, spasimo humanost“

Beograd, 23. avgust 2021. godine – Sa ciljem da poveća svest građana o problemu bacanja hrane i nedovoljnih donacija hrane, ali i da doprinese unapređenju praksi koje će podstaći povećanje donacija hrane, Koalicija za dobročinstvo predvođena Fondacijom Ana i Vlade Divac, uz finansijsku podršku Američke agencije za međunarodni razvoj (USAID), pokrenula je 23. avgusta kampanju „Spasimo hranu, spasimo humanost“.
Kampanja, koja će trajati do novembra ove godine, obuhvatiće niz akcija doniranja hrane pred „Nacionalni dan davanja“, kao i tokom samog dana koji se već tradicionalno održava 9. oktobra.
U Srbiji, na granici apsolutnog siromaštva živi sedam odsto stanovništva, odnosno, gotovo pola miliona ljudi. U riziku od siromaštva je gotovo četvrtina populacije (23,2%). Mnogi od ovih građana Srbije zavise od donacija hrane koje su trenutno nedovoljne, dok se prema procenama u Srbiji dnevno baca dva miliona kilograma hrane.
Uprkos tome što se hrana sve više donira, a proizvođači hrane i trgovci žele da doniraju viškove hrane narodnim kuhinjama, bankama hrane i dobrotvornim organizacijama, količina hrane koja se donira i dalje čini samo mali deo u ukupnom višku jestive hrane dostupne u Srbiji. Rešenje ovog problema je u bližoj saradnji svih uključenih aktera.
Prema analizi koju su sproveli Forum za odgovorno poslovanje i Koalicija za dobročinstvo, donacije hrane u Srbiji bi mogle da budu uvećane na godišnjem nivou za vrednost od blizu 160 miliona dinara (na ukupno 700 miliona dinara), ukoliko bi bio ukinut PDV na donacije hrane.
Kada je u pitanju uticaj na životnu sredinu, podaci UN Agencije za hranu i poljoprivredu (FAO) ukazuju da je uništavanja hrane jedan od najvećih zagađivača vazduha sa osam odsto učešća u ukupnoj emisiji gasova koji izazivaju efekat staklene bašte na globalnom nivou.
Kampanjom „Spasimo hranu, spasimo humanost“ želimo da doprinesemo povećanju donacija hrane za najugroženije i smanjenju bacanja hrane koja je još uvek bezbedna za ljudsku upotrebu. Očekujemo veliku podršku građana, kompanija, organizacija civilnog sektora i medija i pozivamo sve da se uključe“ rekla je Ana Košel, direktorka Fondacije Ana i Vlade Divac.

Launch of “Save Food, Save Humanity” Campaign
BELGRADE, August 23, 2021 – In order to increase public awareness of the problem of food waste and insufficient food donations, and also to contribute to the improvement of practices that would encourage increased food donations, the Coalition for Giving led by the Ana and Vlade Divac Foundation, with the financial support of the United States Agency for International Development (USAID), launched the campaign “Save Food, Save Humanity” on August 23.
The campaign, which will run until November this year, will include food donation actions before the National Day of Giving , as well as during the day itself, which is traditionally held on October 9.
In Serbia, seven percent of the population lives on the edge of absolute poverty, that is, almost half a million people. Almost a quarter of the population (23.2%) is at risk of poverty. Many of these Serbian citizens depend on food donations, which are currently insufficient, while an estimated two 2 million kilograms of food are thrown away daily in Serbia.
Despite the fact that food donations are increasing, and food producers and merchants want to donate surplus food to soup kitchens, food banks and charities, the amount of food donated still makes up only a small portion of the total surplus edible food available in Serbia. The solution lies in the closer cooperation of all stakeholders.
According to analysis conducted by the Responsible Business Forum and the Coalition for Giving, food donations in Serbia could increase annually by a value of nearly 160 million dinars (to a total of 700 million dinars), if the VAT on food donations were to be abolished.
When it comes to environmental impact, data from the UN Food and Agriculture Organization (FAO), indicate that food destruction is one of the biggest air pollutants, generating eight percent of global greenhouse gas emissions.
“With the ’Let’s save food, let’s save humanity’ campaign, we want to contribute to increasing food donations for the most vulnerable and to reduce the waste of food that is still safe for human consumption. We expect great support from citizens, companies, civil society organizations and the media, and we invite everyone to get involved,” said Ana Koeshall, Director of the Ana and Vlade Divac Foundation.

The Minister of Health issued an Order on working hours during epidemiological situations
Date March 12. 2021, the Minister of Health is based on Article 14 of the Decree on measures to prevent and control infectious diseases COVID-19 (“Official Gazette of RS”, No. 151/20, 152/20, 153/20, 156/20 158/20, 1/21, 17/21, 19/21, and 22/21), at the proposal of the Crisis Staff for the Suppression of Infectious Diseases COVID- 19, issued an Order on working hours during an unfavorable epidemiological situation during infectious diseases COVID-19 “Official Gazette of RS “, no. 22 dated March 12. 2021, no. 23 from March 16. 2021, no. 25 from March 21. 2021.
The most important novelty issued by the Order to the Regulation on Measures for the Prevention and Control of Infectious Diseases COVID-19 is that during working hours in all facilities that are allowed to work, a legal entity or entrepreneur must provide distance between all persons present so that it cannot be less than 9 square meters per person, while before the Order was issued, the distance between two people was only 4 square meters. In gyms/fitness centers/spa, it can stay concerning physical distance, as well as the obligation that only one person can stay on every 16 square meters.
The Order itself regulates Article 8 of the Regulation on Measures for the Prevention and Control of Infectious Diseases COVID- 19 which refers to the performance of work during the performance of work of legal entities and entrepreneurs who perform activities in the field of retail trade and services in the field of catering, which includes the sale of beverages and food indoors and outdoors and regulating the way they can perform their activity in compliance with all preventive measures prescribed by the Regulation, which apply to users service as well as to the employees themselves.
The Order introduces restrictions for the above-mentioned legal entities and entrepreneurs who will not be able to perform their activity from March 21. 2021 until the future Decision revoking the Order of the Minister’s health.
From March 21. 2021, as long as the epidemiological situation dictates, the facilities in which they are located will not work perform activities:
Provision of services in the field of catering, which include the sale of beverages and food (restaurants, cafes, clubs, rafts …);
Providing services in closed or open shopping centers and similar facilities in which activities are performed in the field of retail trade (shopping centers…).
Also, the mentioned restrictions do not apply to the working hours of pharmacies, trade, and other shops points of sale where food products are sold, pet shops … Then, no does not apply to restaurants within accommodation facilities and in categorized private accommodation, where the service is provided only to persons who have registered residence, as well as to legal entities of the delivery service food.
Working hours are arranged from 06.00 to 20.00 for retail stores, craft shops, facilities from areas of sports (gyms, gym spa centers…), and from 06.00 to 21.00 facilities can work trade and other shops selling food products, pet shops, markets, cultural facilities (galleries, museums …).
The question that arises these days is, is the obligatory distance of 9 square meters related to office space and work? Is, for example, the employer in office obliged to provide physical distance between employees and in what way? Ministar zdravlja doneo Naredbu o radnom vremenu za vreme epidemiološke situacije
Dana 12.03.2021. godine, Ministar zdravlja je na osnovu člana 14. Uredbe o merama za sprečavanje i suzbijanje zarazne bolesti COVID-19 („Službeni glasnik RS”, br. 151/20, 152/20, 153/20, 156/20, 158/20, 1/21, 17/21, 19/21 i 22/21), na predlog Kriznog štaba za suzbijanje zarazne bolesti COVID-19, doneo Naredbu o radnom vremenu za vreme nepovoljne epidemiološke situacije tokom trajanja zarazne bolesti COVID-19 “Službeni glasnik RS”, br. 22 od 12.03.2021 godine, br. 23 od 16.03.2021. godine, br. 25 od 21.03.2021. godine.
Možda i najbitnija novina koju donosi Naredba u odnosu Uredbu o merama za sprečavanje i suzbijanje zarazne bolesti COVID-19 je ta da u toku radnog vremena u svim objektima kojima je dozvoljen rad, pravno lice ili preduzetnik mora obezbediti rastojanje između svih prisutnih lica, tako da ono ne može da bude manje od 9 metara kvadratnih po osobi, dok je u pre donošenja Naredbe, rastojanje između dve osobe bilo tek 4 metra kvadratna. U teretanama/ fitnes centrima/spa dozvoljen je boravak uz poštovanje fizičke distance, kao i obaveze da na svakih 16 metara kvadratnih može boraviti samo jedno lice.
Sama Naredba reguliše dodatno član 8. Uredbe o merama za sprečavanje i suzbijanje zarazne bolesti COVID-19 koji se odnosi na obavljanje rada pravnih lica i preduzetnika koji obavljaju delatnost u oblasti trgovine na malo i usluge u oblasti ugostiteljstva, a što obuhvata prodaju pića i hrane u zatvorenom i otvorenom prostoru, te regulisanje načina na koji mogu da obavljaju svoju delatnost uz poštovanje svih preventivnih mera propisanih Uredbom, koje se primenjuju na korisnike usluga kao i na same zaposlene.
Naredbom se uvode ograničenja za gorenavedena pravna lica i preduzetnike koji neće moći da obavljaju svoju delatnost od 21.03.2021. godine do buduće Odluke kojom se ukida Naredba Ministra zdravlja.
Od 21.03.2021. godine, dok god to nalaže epidemiološka situacija, neće raditi objekti u kojima se obavljaju delatnosti:
- Pružanje usluga u oblasti ugostiteljstva, koje obuhvataju prodaju pića i hrane (restorani, kafići, klubovi, splavovi…);
- Pružanje usluga u zatvorenim ili otvorenim trgovinskim centrima i sličnm objektima u kojima se obavlja delatnost u oblasti trgovine na malo (tržni centri…).
Takođe pomenuta ograničenja se ne odnose na radno vreme apoteka, trgovinskih i drugih radnji i prodajnih mesta na kojima se vrši prodaja prehrambenih proizvoda, pet shopovima. Takođe, ne odnosi se ni na restorane u sklopu smeštajnih objekata i u kategorizovanom privatnom smeštaju, gde se usluga pruža samo licima koji imaju prijavljen boravak, kao ni na pravna lica usluge dostave hrane.
Uređeno je radno vreme od 06.00 do 20.00 časova za trgovine na malo, zanatske radnje, objekti iz oblasti sporta (teretane, vežbaonice, spa centri…), a od 06.00 do 21.00 čas mogu raditi objekti trgovinske i druge radnje na kojima se vrši prodaja prehrambenih proizvoda, pet shopovi, pijace, objekti u oblasti kulture (galerije, muzeji…)
Pitanje koje se ovih dana javlja, jeste, da li se obavezno rastojanje od 9 metara kvadratnih odnosi na kancelarijski prostor i rad? Igor Živkovski Selected as a Juror for the 2020 CEE Deals of the Year Awards
Živković Samardžić Corporate and M&A Partner Igor Živkovski has been selected as a juror for the 2020 CEE Deals of the Year Awards — the most prestigious and sought-after peer-selected awards for the legal industry in Central and Eastern Europe.
The CEE Deals of the Year Awards were created in 2017 by CEE Legal Matters, the leading source of news and information about the lawyers and legal industry in Central and Eastern Europe, to celebrate the transactions, financings, IPOs, and other deals that underpin growth throughout the reason — and the lawyers and law firms who make them happen. Five jurors are selected by CEE Legal Matters for each of the 24 jurisdictions in the region based on their reputation, expertise, knowledge, and established commitment to their markets.
CEE Legal Matters’ Executive Editor David Stuckey, who oversees the selection of the jurors each year, was pleased that Igor Živkovski agreed to commit his time and effort to the process of evaluating and ranking the many submissions made by law firms in Serbia. “Jurors were selected based on our personal interactions with them, their reputation among their peers, and the kinds of deals they have ushered to completion themselves over the years,” Stuckey said. “It is difficult to imagine a more skilled or knowledgeable panel of legal experts in Serbia, and a significant part of that comes from Igor. We are delighted and honored that he agreed to participate, and the process is more trustworthy and reliable as a result.”
Igor served as a member of the Shortlist Selection Panel for the 2019 CEE Deals of the Year Awards and led Živković Samardžić team which won the 2018 CEE Deal of the Year Award for Serbia.

The Coalition for Giving is calling for the abolition of VAT on food donations

Belgrade, December 1, 2020 – Ever since the introduction of the value added tax (VAT) in Serbia sixteen years ago, VAT has also been collected on food donations. According to data from 2018, almost 500,000 people in Serbia are not able to meet basic living needs, including food, and the levying of VAT on food donations makes it even harder to help these people.
The abolition of VAT in Serbia would increase food donations by nearly 160 million dinars and would total almost 700 million dinars annually. This would provide approximately 1.2 million additional meals in soup kitchens per year. The proposal is supported by 88% of the population of Serbia according to the survey from September and October 2020.
Therefore, the members of the Coalition for Giving submitted a proposal to the Ministry of Finance to abolish the VAT on food donations before the food expiration date through the new Draft on Amendments to the Law on VAT. The proposal is based on best European practices and EU guidelines. Twenty out of 27 EU countries do not charge VAT on donated food. Additionally, according to the UN Food and Agriculture Agency, by-products of food destruction are one of the biggest air pollutants and have a 8% share in the total greenhouse gas emissions at the global level.
“Given that almost half a million people in Serbia cannot meet basic living needs and that the destruction of food is harmful to the environment, we recommend that VAT on food donations should be abolished. Currently, it is cheaper for companies to wait for the food to expire and destroy it without paying VAT, instead of donating it while the food is still good for use,” the Coalition said.
Amendments to the Law on VAT would create an opportunity for companies to donate food worth hundreds of thousands of euros to the most vulnerable citizens and contribute to the fulfillment of the United Nations’ sustainable development goals, to which Serbia is committed.
Members of the Coalition for Giving – Ana and Vlade Divac Foundation, Trag Foundation, Smart Kolektiv, Catalyst Balkans, Serbian Philanthropy Forum and Forum for Responsible Business submitted the proposal based on the analysis of a cost-benefit analysis of abolishing the obligation to pay VAT in Serbia conducted within Framework for Giving project implemented by the Coalition for Giving and funded by the USAID.

Živković Samardžić on the public discussion of the Draft of the Law on Accounting at the Serbian Chamber of Commerce
At the initiative of SMART kolektiv, which was supported by the Koalicija za dobročinstvo (Coalition for benevolence) (LPF) whose members are the representatives of the Živković Samardžić Law Office, Kruna Savović and Nataša Sarić, a public discussion was implemented regarding the Draft of the Law on Accounting, in the period from August to September 2019. In the last year and a half, intensive work was carried out to prepare the draft of the law and the deficiencies shown by the practice of implementing the existing laws during six years were identified through many meetings.
Participants in this public discussion were the representatives of state authorities and institutions, representatives of business associations, such as the Serbian Chamber of Commerce, Foreign Investors Council, American Chamber of Commerce and others, as well as the representatives of auditing and accounting associations and representatives of the academic and civil sector. All participants in the public discussion participated actively and stated their comments regarding the text of the Draft of the Law on Accounting, where during a single public discussion more than 80 different participants submitted their comments regarding the text of the Draft of the Law on Accounting.
The reasons for objections to the Draft of the Law on Accounting submitted by the participants mostly referred to improving the quality of corporate financial reporting and strengthening the trust in financial and audit reports, as well as compliance with the requirements of the new EU regulations and meeting one of the measures for closing chapter six, as well as eliminating the detected deficiencies in existing decisions.
The team consisting of SMART kolektiv and attorneys from the Živković Samardžić Law Office proposed a change to the draft of the law which was adopted in the part referring to non-financial reporting by additional detailing of the obligations of compiling and the manner of compiling these reports. Additionally, the proposal of the team consisting of Smart Kolektiv and Živković Samardžić attorneys stating that other legal entities referred to in Article 2 of the Draft of the Law on Accounting (associations, foundations, endowments, etc.) should still implement special bylaws regulating the Chart of Accounts and the contents and form of financial statements forms, just like in the previous Law on Accounting, was accepted as well.
All mentioned proposals to amend the draft of the Law on Accounting have the purpose to improve the transparency of operation of civil organizations (associations, foundations, endowments) and prevent potential violation of the legal norm.
The law has been in the assembly procedure since 16 September 2019.
