Personal data protection – stance and opinions of the Commissioner Type: Microsoft Word Document

The Commissioner for Information of Public Importance and Personal Data Protection marked the Day of Personal Data Protection, which has been celebrated in Serbia for 10 years. This year also commemorates the 40th anniversary of the opening for signature of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data. Following the adoption of the new Law on Personal Data Protection, there has been an obligation to align with its provisions. The law raised numerous questions and uncertainties in practice, leading data controllers and processors to rely primarily on previous guidelines and opinions issued by the Commissioner.

To address these challenges, the Commissioner has now published Poverenika publikacija broj VI: Zaštita podataka o ličnosti: Stavovi i mišljenja Poverenika, a publication that includes the Commissioner’s opinions on common dilemmas in applying the Law. These cover a range of issues such as the scope of the Law, the definition of personal data, respect for principles, the roles of controllers and processors, the role of data protection officers, rights of data subjects, processing data of minors, obligations concerning video surveillance, data transmission, data protection in labor law, processing special categories of personal data, and more.

In the context of the 2020 pandemic, the importance of personal data protection became especially evident. The publication also addresses specific issues regarding the prevention of the spread of COVID-19.
