‘’On One’s Own Land” – Key Steps Toward Secure Legalization

With the adoption of the Law on Special Conditions for Recording and Registration of Property Rights (popularly known as “On One’s Own Land”), the state has opened the possibility for owners of illegally constructed buildings to finally obtain legal ownership status and register their ownership rights through a significantly simplified procedure.

What “On One’s Own Land” means for property owners

  • Registration is possible even if the building was constructed illegally, including cases where no building permit or technical inspection was obtained;
  • The procedure is digitalized: applications are primarily submitted through a digital platform, while traditional submission at the municipality or by post remains available;
  • In addition to personal details, information about the property is required (cadastral parcel or address, building ID or map designation, type and total area of the building, number of floors), as well as proof of acquisition of the property (e.g., contract, inheritance, court decision);
  • A prerequisite is that the building is not located in an area subject to legal restrictions (protected zones, land owned by another person, expropriation, and similar limitations).

Why is it important to carry out legalization properly

  • Registering ownership rights provides legal and commercial security. Once registered, the property acquires real market value and may be legally transferred, sold, used as collateral, or otherwise commercially exploited;
  • If an application is not submitted within the prescribed deadline or is not supported by proper documentation, there is a risk that the state may register ownership rights in its own favor or that the competent authority may order the removal of the building;
  • Errors in documentation, unclear or incomplete information, or lack of proof of ownership rights to the associated land may result in the rejection of the application or lead to subsequent legal issues (disputes, incorrect registrations, and similar complications).
