Implementation of the MORATORIUM to credit card obligations

In our previous article, we reported about  Decision on interim measures aimed on preservation of stability of financial system in the Republic of Serbia (Official Gazette of Republic of Serbia, No 33/2020 hereinafter: Decision), which came into force on march 18, 2020, and which has introduced a moratorium on the payment bank loan obligations (see more: http://www.zslaw.rs/covid-19-legal-alert-90-days-moratorium-on-loan-repayments-in-serbia/).

One of the doubts that come out in the application of the Decision in practice is whether the moratorium applies to the payment obligations incurred from use of credit card and overdraft services.

In that regard, the Decision does not regulate explicitly this matter, but, given that credit card services and overdrafts are, by their legal nature, credit products, we consider that the moratorium should be applied to the obligations arising from these credit products as well.

It remains to be seen how banks will act in practice, as well as, will the National Bank of Serbia will provide any clarification on this matter. We will continue to monitor the situation and report regularly on our blog dedicated to legal topics related to the COVID 19.

Primena MORATORIJUMA na obaveze po osnovu  korišćenja kreditnih kartica

U našoj prethodnoj vesti, pisali smo o Odluci o privremenim merama za očuvanje stabilnosti finansijskog sistema (“Služebni glasnik Republike Srbije”, br. 33/2020, u daljem tekstu: Odluka) koja je doneta dana 18. marta 2020. godine, a kojom je uveden moratorijum na plaćanje obaveza iz kredita (videti opširnije: http://www.zslaw.rs/covid-19-legal-alert-90-days-moratorium-on-loan-repayments-in-serbia/).

Kao jedna od nedoumica koja se javila u praksi je i to da li se moratorijum odnosi i na plaćanje obaveza nastalih po osnovu korišćenja kreditnih kartica, odnosno korišćenja dozvoljenog prekoračenja po računu.

S tim u vezi, Odluka ne daje eksplicitan odgovor na ovo pitanje, međutim, imajući u vidu da usluge kreditnih kartica, odnosno korišćenja dozvoljenog prekoračenja po računu jesu po svojoj pravnoj prirodi kreditne usluge, smatramo da se moratorijum treba primenjivati i na obaveze korisnika ovih kreditnih usluga. 

Ostaje da se vidi kako će banke postupati u praksi, kao i da li će se Narodna Banka Srbije izjasniti naknadno po ovom pitanju. Mi ćemo pratiti situaciju i redovno o novostima izveštavati na našem blogu posvećenom pravnim dešavanjima u vezi sa merama povodom COVID 19.
